This privacy policy describes how SPIA Cycling Inc. ("SPIA", "we", "us" or "our") collects, uses, and discloses personal data when you visit our website (https://stagescycling.com/), purchase a product or service, sign up to our newsletter, sign up to receive communications from us, or otherwise interact with us. This privacy policy also describes how we use and disclose personal data about you and the rights that you can exercise in relation to your personal data. This privacy policy does not apply to the States Cycling App.

It is important that you read this privacy policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them. In some cases, we may provide different or additional policies or notices about our information practices.

1. The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data or information where the identity or identifiers have been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

Identity Data includes first name, last name, username or similar identifier, date of birth and gender.

Contact Data includes billing address, delivery address, email address and telephone numbers.

Financial Data includes bank account and payment card details.

Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.

Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.

Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses. 

Usage Data includes information about how you use our website, applications, products and services.

Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

We also collect, use Aggregated Data such as statistical data or any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website or application feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

We do not collect any Special Categories of Personal Data, Sensitive Personal Information or Sensitive Personal Data, as defined under the applicable laws, about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.

This website is not intended for, or designed to be attractive to, children under the age of 16 and we do not knowingly collect data relating to such children

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

2. How is your personal data collected?

We use different methods to collect data from and about you including through:

Information you provide to us. You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

purchase our products or services (whether online or in-store);

Automated technologies or interactions. As you interact with our website or applications, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. (with your consent, where required under applicable law). We use cookies and similar technologies to help us remember you and your preferences when you revisit our website or applications. We may allow selected third parties to place cookies on our websites or applications to provide relevant advertising to you.  These third parties may collect information about a consumer’s online activities over time and across different websites when he or she uses our website. We may also permit third party service providers to place cookies through our website or applications to perform analytic or marketing functions.  We do not control the use of such third-party cookies or the resulting information and we are not responsible for any actions or policies of such third parties. You can remove cookies from your computer through the browser settings. Please note however that doing so may affect, limit or degrade your ability to use of some features.

We do not currently use technology that recognizes a “do-not-track” signal from your web browser.

Marketing

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.  You can update your marketing preferences at any time by following the opt-out links on any marketing message sent to you, or by emailing [email protected]. This will not stop us from sending emails about your account or your transactions with us. 

You may receive marketing communications from us if you have requested information from us or purchased goods or services from us and you have not opted out of receiving that marketing.

If you are based in the EEA or UK, or if otherwise required by applicable law, we will get your express opt-in consent before we share your personal data with any third party for marketing purposes.

4. Disclosures of your personal data

We may share your personal data with the third parties, such as:

Other companies in the Giant Group that are involved in the provision of products or services to you;

Service providers, vendors, and contractors who perform services on our behalf and who may act as processors (e.g., who provide IT and system administration services, payment processing services, customer service, or marketing).

Professional advisers, such as lawyers, bankers, auditors and insurers (e.g., where they are providing us with advice or when we need to make a claim on any insurance policies).

Regulators and authorities who require reporting of processing activities in certain circumstances (e.g., tax authorities or authorities responsible for preventing fraud).

Law enforcement authorities that submit binding legal requests for information that includes your personal data.  We may also share personal data on receipt of non-binding requests where we consider that it is in our legitimate interests to do so and this is not outweighed by your fundamental rights and freedoms.

Where your personal data is relevant to any litigation or alternative dispute resolution in which we are involved, we may share your personal data with the other parties to that dispute or the courts (e.g., in disclosure or discovery).

Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets (or other third parties for example when connected with due diligence or planning exercises undertaken in relation to such a transaction). Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Our website or applications may contain links to other websites whose data practices may be different than ours. Please consult all third-party sites’ privacy notices. We have no control and disclaim any and all responsibility and liability in connection with information that is submitted to, or collected by, third parties.

6. International transfers of EEA and UK personal data

Personal data that we process about you may in some cases be further transferred to third parties that are based outside the UK and the European Economic Area (“EEA”). Where necessary, we ensure appropriate safeguards are in place for transfers to such third parties to protect your personal data (such as model clauses approved for this purpose by the EU Commission and the UK Information Commissioner).

You have a right to contact us for more information about the safeguards we have put in place (including a copy of relevant contractual commitments) to ensure the adequate protection of your personal information when it is transferred outside the UK or EEA. 7. Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. How long will we use your personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

9. Your legal rights

If you reside in the U.S.:

Accessing or Correcting Your Information.  You can access, correct, or delete certain information by emailing [email protected].

Location Information.  If our mobile applications collect precise location information, you will be asked to consent to the collection of this information.  If you initially consent to the collection of such information, you can subsequently stop the collection of this information at a later time by modifying the preferences on your mobile device.

Push Notifications.  With your consent, we may send push notifications or alerts to your mobile device.  You can stop these notifications/alerts at any time by changing the preferences on your mobile device.

Promotional Emails.  You can choose not to receive emails from us by “unsubscribing” using the instructions in any email you receive from us.  This will not stop us from sending emails about your account or your transactions with us. 

Cookies.  You can choose to delete or block cookies by setting your browser to either reject all cookies or to allow cookies only from selected sites. If you block cookies performance on our website, it may be impaired and certain features may not function at all.

Under certain circumstances, you have rights under data protection laws in relation to your personal data:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. In certain circumstances, this enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (i) if you want us to establish the data's accuracy; (ii) where our use of the data is unlawful but you do not want us to erase it; (iii) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (iv) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

You also have the right to make a complaint at any time to the relevant supervisory authority in the jurisdiction in which you are based, such as the Information Commissioner’s Office (the UK regulator for data protection issues). No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

We do not sell or share information considered to be “sensitive personal information” for marketing or advertising purposes. We do not sell or share any personal information that we know to belong to consumers under age 16.

You have the right to opt-out of having your personal information shared, sold, or used for targeted advertising or profiling.  See Your Privacy Rights section below for details on exercising your opt-out rights.

Opting Out of Sales, Sharing, and Targeted Advertising. You have the right to opt-out of having your personal information shared, sold, or used for targeted advertising or profiling.

Access, Correction, and Deletion. Subject to certain exceptions and limitations found in the relevant laws, you have access, correction, and deletion rights.

You have a right to request details about the information we have collected about you and how such information is used and disclosed.  You also have a right to obtain your personal information in a format that is portable. 

Depending on your state of residence in the U.S. you may also have a right to ask us to correct inaccurate information, subject to the nature of the personal information collected and how it is used. 

You further can request that we delete personal information that we have collected about you. We will honor your request to the extent required by applicable law and subject to certain legal exceptions, like if we need to retain information for legitimate business purposes.

Appeals.  There may be times when we deny your privacy requests. Depending on your state of residence in the U.S. you may have a right to appeal these decisions.  If you have concerns about your appeal, you may contact the attorney general of your state.

Non-Discrimination.  We will not discriminate against you for exercising your privacy rights.

Authorized Agents.  Depending on your state of residence in the U.S. you may designate an authorized agent to submit privacy right requests on your behalf. We may ask for proof of a designated agent’s authority and confirm that they are registered with the appropriate state authorities.  In some circumstances, we may contact you to verify your identity and confirm that the agent has your permission to submit a request.

4. Financial Incentives / Bona Fide Loyalty Program Disclosure

We offer our customers certain perks such as sweepstakes, contest, or other similar promotional campaigns (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information and offering of certain benefits, they might be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. Under the California law, the value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.

You may withdraw from participating in a Program at any time by contacting us using the designated method set forth in the applicable Program rules.
