This privacy policy describes how SPIA Cycling Inc. ("SPIA", "we", "us" or "our") collects, uses, and discloses personal data when you use our Stages Cycling App ("App”). This privacy policy also describes how we use and disclose personal data about you and the rights that you can exercise in relation to your personal data.
It is important that you read this privacy policy together with any other privacy policy or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them. In some cases, we may provide different or additional policies or notices about our information practices.

We do not collect any Special Categories of Personal Data, Sensitive Personal Information or Sensitive Personal Data, as defined under the applicable laws, about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data or information about criminal convictions and offences).
However, we may collect limited data about you that could arguably be used to infer further data regarding your health (e.g., functional threshold power, cadence, balance, heart rate and calorie consumption), in order to support certain features of the App (“Physiological Data”). Notwithstanding that such personal data may not constitute Special Category Personal Data, this data will only be used with your explicit consent for the purposes described at the point of collection and will be processed in accordance with applicable data protection laws.
This App is not intended for, or designed to be attractive to, children under the age of 16 and we do not knowingly collect data relating to such children.
If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

This will not stop us from sending emails about your account with us.
You may receive marketing communications from us if you have requested information from us or purchased goods or services from us and you have not opted out of receiving that marketing.
If you are based in the EEA or UK, or if otherwise required by applicable law, we will get your express opt-in consent before we share your personal data with any third party for marketing purposes. We may share your personal data with the third parties, such as:
If you choose to log in to the App using your social media account, we only collect your email address and profile photo. We do not collect any other information or share any data with your social media platform. Personal data that we process about you may in some cases be further transferred to third parties that are based outside the UK and the European Economic Area (“EEA”). Where necessary, we ensure appropriate safeguards are in place for transfers to such third parties to protect your personal data (such as model clauses approved for this purpose by the EU Commission and the UK Information Commissioner).
You have a right to contact us for more information about the safeguards we have put in place (including a copy of relevant contractual commitments) to ensure the adequate protection of your personal information when it is transferred outside the UK or EEA. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. - Identity Data includes first name, last name, username or similar identifier, date of birth, weight, and gender.
- Contact Data includes email address.
- Technical Data includes your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, device make and model, and other technology on the devices you use to access this App.
- Location Data includes GPS technology used to determine your current location. This is collected when you activate location-enabled services such as Google Maps or other embedded mapping features.
- Profile Data includes your username and password, your interests, preferences, feedback and survey responses.
- Usage Data includes information about how you use our App, products and services.
- Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

For example, Usage Data will be collected when you use our App. Some of our location-enabled applications require your Location Data (but not precise geolocation) for certain features to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by disabling Location Data in the settings.
- Automated technologies or interactions. Technical Data about your equipment and use of the App may be collected where you have given your consent for us to collect such data for analytics purposes. Where such consent has been provided, we use such data to analyse the performance of the App and to report any bugs that you may experience.
- Third parties or publicly available sources. We will receive personal data about you from various third parties and public sources as set out below:
- Technical Data from analytics providers, such as Google (which provides anonymized and aggregated data only) and Firebase (which provides analytics and bug reports if you have consented for this information to be processed).
- Contact, Financial and Transaction Data from providers of technical, payment, and delivery services.
- Location Data from embedded maps providers, such as Google in order to plot your starting point and route.
- Identity and Contact Data from publicly available sources.
- Where we need to perform the contract we are about to enter into or have entered into with you.
- Where it is necessary for our legitimate business interests (or those of a third party) and your interests and fundamental rights do not override those interests.
- Where we need to comply with a legal obligation.
- Where we have your consent to do so.

- Push Notifications. With your consent, we may send push notifications or alerts to your mobile device. You can stop these notifications/alerts at any time by changing the preferences on your mobile device.
- Promotional Emails. You can choose not to receive emails from us by “unsubscribing” using the instructions in any email you receive from us. This will not stop us from sending emails about your account with us.

- Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Your Privacy Rights
Opting Out of Sales, Sharing, and Targeted Advertising. You have the right to opt-out of having your personal information shared, sold, or used for targeted advertising or profiling. As stated above, we do not “sell” or “share” your personal information or use your personal information for “targeted advertising” so we do not offer this right.
Access, Correction, and Deletion. Subject to certain exceptions and limitations found in the relevant laws, you have access, correction, and deletion rights.
You have a right to request details about the information we have collected about you and how such information is used and disclosed. You also have a right to obtain your personal information in a format that is portable.
Depending on your state of residence in the U.S. you may also have a right to ask us to correct inaccurate information, subject to the nature of the personal information collected and how it is used.
You further can request that we delete personal information that we have collected about you. We will honour your request to the extent required by applicable law and subject to certain legal exceptions, like if we need to retain information for legitimate business purposes.
Appeals. There may be times when we deny your privacy requests. Depending on your state of residence in the U.S. you may have a right to appeal these decisions. If you have concerns about your appeal, you may contact the attorney general of your state.
Non-Discrimination. We will not discriminate against you for exercising your privacy rights.
Authorized Agents. Depending on your state of residence in the U.S. you may designate an authorized agent to submit privacy right requests on your behalf. We may ask for proof of a designated agent’s authority and confirm that they are registered with the appropriate state authorities. In some circumstances, we may contact you to verify your identity and confirm that the agent has your permission to submit a request.
